While few people enjoy thinking about it, it is absolutely essential that you prepare your Will (and other documents such an Enduring Power of Attorney and Appointment of Enduring Guardian) before it is too late.
For most of our clients, the preparation of their Wills is a straightforward process.
Before making an appointment to see one of our solicitors, it’s a good idea to start thinking about the following points:
1. Who do you want to act as your executor?
The executor is the person who is “in charge” when you passes away. They would have duties such as arranging the funeral, contacting a solicitor to assist them in administering the estate and making a distribution of your assets in accordance with the terms of your will. You can appoint anyone as your executor, but there are important things to take into account when making your decision.
2. What do you want to happen to your assets?
You need to decide who is going to inherit your assets when you pass away. It is up to you as to who you leave your assets to – be that family, friends or charitable organisations – but there are important things to consider in making your decision (for example, whether anybody is eligible to contest your Will).
It can be difficult to think about these things and it may not be a straightforward exercise for all of our clients.
